How to Buy Properties Subject to the Existing Note

Jay Conner explains how to buy properties that are subject to the existing note.
“Who, in their right mind, would sell their house, leave the mortgage in their name, and trust you will make their payment?”
When I first heard about closing deals subject to the existing note, this was the first question that popped into my mind. This method of buying properties sounded impossible!
When I say “subject to,” I mean buying a home, or any property, subject to the existing mortgage. In short, I buy a house from a seller, the deed is transferred into my entity's name, and I agree to make the seller's mortgage payments. However, the mortgage stays in the seller's name until I sell the property to a new buyer.
There are plenty of reasons why I buy properties subject to the existing note, but who would be willing to sell me their house while still being responsible for the mortgage?
For a seller, it sounds like a big risk. Where's the guarantee that I will pay their mortgage that remains in their name?
When I first started talking to potential sellers about buying their properties “subject to,” I quickly learned that it was my motivated sellers who were willing to take me up on the offer.
Who is my Motivated Seller? After many years of buying properties “subject to,” I've learned how to review a seller's property information sheet and quickly determine if it is a possible “subject to” deal.
From my experience, the strongest candidates for “subject to” are sellers who are currently behind on their payments. Recently, I bought a house “subject to” from a seller who was four months behind on their payments. If the seller has a mortgage, I talk to them about selling subject to the existing note.
In order to buy a property “subject to,” there has to be a current mortgage in place. Obviously, sellers who own their house free and clear of any mortgages aren't going to sell “subject to.” On a free and clear house, I negotiate to buy with seller financing.

Jay Conner became known as The Private Money Authority back in 2009 because when he and his wife Carol Joy started investing in single-family houses in Eastern North Carolina back in 2003, they initially relied on local banks and mortgage companies.
They had a rude awakening in January of 2009. Jay got cut off from the local banks with no notice like the rest of the world did when during the global financial crisis.
Right then and there, he knew he had to find a better and more efficient way to get deals funded. That’s when he learned about private money.
Jay was able to raise over $2 million in private funding from the time he started attracting private money.
While there are many creative ways to buy properties, at the end of the day, most of the deals are done and concluded by having all the cash ready to go.

Don't Do This!
Jay talks about one of his recent real estate deals and why he walked away!
He talks in detail about a story that reminds him of the very popular Kenny Rogers song The Gambler; "Know When to Hold Them and Know When to Fold Them."
This is important because if you don’t know when to fold your cards and walk away from a play or walk away from a deal that can be so much more expensive than the actual profit that you could be making on it.
One of the most important lessons that Jay has learned since investing in single-family houses in 2003 and rehabbing over 400 houses, is that you need to know when to walk away. Do not fall in love with a deal just because of having a deal!
In fact, this story about 112 Charles Street, has really great numbers. It looks like there’s a spread of a potential $100,000 in this deal.
But after analyzing the deal and doing the due diligence, there was no profit to be made. In reality, it’s got a loss of over $20,000.
Jay details step by step on how to properly analyze the numbers and understand when you should fold on a deal.

Raised in Yuma, AZ, Rafael Cortez is a second-generation entrepreneur. He began his first job at the age of 14 at a local grocery store. From 15 to 18 years of age, his work experience included everything from construction to supervisory positions in retail and customer service, all while attending the Fire Science Program at Arizona Western College.
At the age of 19, Rafael became one of the youngest firefighters in Yuma County, where he spent the next 5 years of his professional career. While providing EMS and fire services in Yuma, Rafael recognized a need in his community and began working on his first entrepreneurial project, a non-emergency medical transportation business.
He launched Netcor Transports LLC in 2007 at the age of 23 and maintained constant logistical and economic growth until he successfully sold the company in 2014.
Rafael is currently an Organizational Psychologist and real estate professional holding ownership in multiple companies in various verticals.
